By logging into your account, or uploading files to it, you are indicating your acceptance of these Terms and Conditions.

Domain Names

You must ensure that you are legally entitled to register any domain name that you purchase.

If for some reason we are unable to register the domain that you have ordered then we will refund the amount paid by you for the domain name. We accept no responsibility in the event that we are unable to register a particular domain.

Renewal fees for domain registration, hosting and any other service where a renewal fee applies are payable by the renewal date to ensure continuity of service(s).

Users must not participate in any form of un-solicited bulk e-mailing or spam.

Domain Transfers

Please contact us before making payments for any domain transfers. In the event that you make a payment for a domain transfer without contacting us first, and we are unable to complete the transfer for any reason, then we will refund the payment made and reserve the right to deduct any out of pocket expenses that we may incur.

Hosting

Your server space and hosting account is for your use only. You must not divulge the password to any other person, and you should take reasonable precautions to ensure that it is not discovered by any other party.

It is recommended that you keep an independent backup of all data stored on your web space.

You may not run server processes (eg. talkers/IRC Bots) from your web space.

We shall not be held liable for any loss or damages caused by the use or misuse, unavailability or removal of services.

Each hosting package has a generous data storage allowance associated with it.
In the unlikely event that your data storage exceeds the amount in the relevant hosting package, then we reserve the right to contact you to agree a revised fee.

We do not allow Adult, Warez, illegal MP3 Sites or IRC Bots.

Users must not participate in any form of un-solicited bulk e-mailing or spam.

In the event of non-payment of a hosting renewal, the hosting account will be de-activated automatically. If the renewal payment is made within 30 days of  de-activation then the account will be re-activated and the original renewal date applied. If the account remains unpaid after 30 days of de-activation, we reserve the right to remove all files from the server and a re-activation fee may be applicable, at our discretion.

Bandwidth

Each hosting package has a generous bandwidth allowance associated with it.
In the unlikely event that your bandwidth exceeds the amount in the relevant hosting package, then we reserve the right to charge £3.50 for each GB that exceeds the limit.

Web Design / Web Pages

All prices are subject to confirmation at time of placing order. Payment of 50% of the project cost is required before work can begin (deposit), balance upon completion (unless agreed otherwise). Your instruction to proceed with our services (written or oral) constitutes an agreement between us and signifies your acceptance of these terms and conditions.

In the event that the final project specification differs from the specification against which the project was originally costed, or the specification changes during development, Webways Marketing will advise you of any cost implications at the time the situation arises, and seek your approval prior to carrying out the work.

Charges for domain registration are made on the basis that domains will be available at the time the deposit is made. All HTML, images and other files created by Webways Marketing and forming part of the completed web site become the property of the client upon full settlement, until which time they remain the sole property of Webways Marketing.

Settlement of fees due for hosting, domain registration and any third party services are required at time of placing order. Any discounts or free services offered by Webways Marketing on the basis of volume or value are made available once settlement of the relative invoices has been made.

Webways Marketing does not accept any responsibility for the suitability or function of third party software or scripts. Webways Marketing may make recommendations based on experience and / or documentation, however the final decision as to the suitability and use of third party software or scripts rests with the customer.

Responsibility for the accuracy and content of any and all information contained within, or relating to, the web site and / or services rests with the customer. Whilst information supplied by the customer is published in good faith, Webways Marketing and its representatives cannot accept any liability for any content or errors contained therein.

Hosting

Commercial use of web and ftp space is permitted. 

You will be responsible for the content of your pages, including obtaining the legal permission for any works they include and ensuring that the contents of these pages do not violate UK law. 

You will be held responsible for and accept responsibility for any defamatory, confidential, secret or other proprietary material available via your page(s). 

We reserve the right to remove material deemed inappropriate from your web pages, without prior notice. Webways Marketing do not allow adult, warez or illegal MP3 web sites on their servers.

Cancellation and Refunds

Domain name registration organisations do not permit refunds on domain name purchases prior to the expiry date of that domain name.

Hosting account purchases are made on the basis of a 12 month contract. Cancellations during this period are not entitled to any pro-rata refund for any unused portion of your account.

Webways Marketing reserves the right to cancel the service at any time. Customer refund requests are to be sent to accounts@webwaysmarketing.co.uk and will only be processed in the cases of service non-performance where Webways Marketing is clearly at fault. Refund requests for problems beyond Webways Marketing's control will be refused.

For example: 
Domain transfer failure. 

Failure of any third party script or program that's not supported by Webways Marketing. 

A customer's lack of experience in dealing with web basics and communication protocols. 

Our entire liability under any circumstances whatsoever shall be limited to the amount actually paid by you for our services.

General

Any misuse of any account or service purchased from or through us may result in the account(s) being cancelled without notice or refund.

Indemnification

Customer agrees that it shall defend, indemnify, save and hold Webways Marketing harmless from any and all demands, liabilities, losses, costs and claims, including reasonable solicitors fees asserted against Webways Marketing, its agents, its customers, officers and employees, that may arise or result from any service provided or performed or agreed to be performed or any product sold by customer, its agents, employees or assigns. Customer agrees to defend, indemnify and hold harmless Webways Marketing against liabilities arising out of:

(1) any injury to person or property caused by any products sold or otherwise distributed in connection with Webways Marketing's server.
(2) any material supplied by customer infringing or allegedly infringing on the proprietary rights of a third party.
(3) copyright infringement.
(4) any defective products sold to customer from Webways Marketing's server. 

Disclaimer

Webways Marketing will not be responsible for any damages your business may suffer, Webways Marketing makes no warranties of any kind, expressed or implied for services we provide. Webways Marketing disclaims any warranter merchantability or fitness for a particular purpose. This includes loss of data resulting from delays, non-deliveries, wrong delivery, viruses and any and all service interruptions caused by Webways Marketing and its employees.

Our entire liability under any circumstances whatsoever shall be limited to the amount actually paid by you for our services. No liability is accepted for consequential loss and / or damages. Webways Marketing does not accept any liability from the use or inability to use any service we provide resulting from circumstances beyond our control.

 Webways Marketing reserves the right to revise these terms and conditions at any time without notice.
